Terms of Service — Gapup MCP

1. Service description

Gapup MCP is a Model Context Protocol server exposing 170+ AI-callable tools at mcp.gapup.io. Operator: Gapup Labs (LLC Wyoming, in formation as of 2026-05).

2. Acceptable use

• Authorized: legitimate AI agents, B2B integrations, security testing on owned assets, research, educational use
• Prohibited: violation of applicable law, mass automated outreach without consent, circumventing rate limits, reverse-engineering for cloning, scraping catalog for competing products, fraud, mass-targeted attacks

3. Pricing & payment

The Service uses x402 micro-payments in USDC on Base mainnet (when X402_ENABLED=true). Each tool has a published tier (T0–T6, $0.002 → $1.50). Pricing subject to change with 30 days notice.

4. Rate limits

60 req/min standard tier, 10 req/min for T4+ tools. Excessive use triggers HTTP 429 with Retry-After header.

5. Data accuracy & disclaimer

Tools aggregate data from third-party public sources (Wikipedia, EDGAR, OFAC, etc.). No warranty of completeness or accuracy. Do not rely solely on Service output for critical legal, financial, medical, or regulatory decisions.

6. Limitation of liability

Operator's total cumulative liability is limited to fees paid by Client over the 12 months preceding the claim. No liability for indirect, consequential, or incidental damages.

7. Governing law

Laws of the State of Wyoming, USA. Disputes before courts of Cheyenne, Wyoming (EU B2B Clients: Brussels I bis Regulation may apply).
